Government makes first move on blocking Porn

Last week was a pretty hectic for all of us. First came the news that government has taken the first step towards blocking pornography. A list of 857 website that was submitted by the petitioner in November, 2014 was used by the Government to instruct all Internet Service Providers (ISPs) to ban pornographic websites.

News was welcome by one and all and especially by some of us who had been working tirelessly on the Supreme court PIL for last two and a half years now. However even before the news could sync in and we could celebrate this small victory, came the news of Government bulking under pressure and thinking of revoking ban. We were a bit dis-heartened and thinking that what is going to happen next. Then came this strange order of to only block sites that are hosting Child Pornography. This was surprising given that ‘ALL’ forms of Pornography is banned under the various acts. Section 67A of the IT Act, amended 2008 clearly states

Whoever publishes or transmits or causes to be published or transmitted in the electronic form any material which contains sexually explicit act or conduct shall be punished on first conviction with imprisonment of either description for a term which may extend to five years and…

67A does not differentiate between Adult or Child Pornography, it says transmission of all forms of Pornography is prohibited, which directly holds the ISPs responsible as the entity performing this data transmission to consumers homes. So it is surprising why the government decided to limit the applicability to child pornography. The ISPs however on their parts expressed the inability to differentiate between Adult Porn and Child Porn and the ban continued. Some good did happen even in the garb of ignorance.

This is first move by the government and clearly this came after Supreme Court observation that no action has been taken by the government on banning Porn sites so far. The order was very much welcome on Social Media and other platforms with one blogger commenting –

It is a very little first step for save our coming generation. Many major step pending for our children’s tomorrow. I personally agree with this that india should ban all the porn sites online.

Another blogger commented on those who are opposing any such ban-

We have policing on alcohol, drugs, weapons – maybe that should all be removed too. Moral policing not good, but restricting harmful and addictive substances from impressionable kids is paramount, to a sane functional society. Well, India is soon going to have many more pressing issues with sexualization of kids, and child abuse soon, with the wide proliferation of hardcore deviant porn among the poor, unemployed, and immature adolescent population.

As they say Better Late than Never. A welcome first move by the NDA government indeed after all these years of inaction under the UPA government.
